Our terms and conditions of use

The general terms and conditions of sale of Innovations On Line Products, whose registered office is located at 5 Esplanade Compans Caffarelli - Bat. A - 31000 Toulouse, apply to all orders and are subject to the conditions listed below. 

They prevail over any other stipulation, written or not, made by the customer. All orders imply full acceptance of these terms and conditions of sale with the exception of special conditions written by Innovations On Line Products at the time of the order. 

It is up to the customer to define his needs, possibly to establish his specifications and to choose his material under his own responsibility. 

After validation of the order, the average delivery time is 5 days and the maximum delivery time is 30 days. 

Innovations On Line Products reserves the right to choose the carrier and guarantees the proper delivery of the goods. 

The products are delivered to the address indicated by the consumer on the order form and only in the geographical areas that we serve, i.e. in Europe and the French overseas departments and territories as well as the following countries Australia, Canada, China, South Korea, United States, Hong Kong, India, Israel, Japan, Russia, Singapore, Thailand, Vietnam, Angola, Antarctica, Saudi Arabia, Armenia, Azerbaijan, Bahrain, Benin, Botswana, Bouvet Island, British Indian, Ocean Territory, Burkina Faso, Burundi, Cameroon, Cape Verde, Central African Republic, Chad, Comoros, Congo, Dem. Republic, Congo, Republic, Cook Islands, Djibouti, Egypt, Equatorial Guinea, Eritrea, Ethiopia, Fiji, Gabon, Gambia, Georgia, Ghana, Guam, Guinea, Guinea-Bissau, Heard Island and McDonald Islands, Mauritius, Iran, Ivory Coast, Kenya, Kiribati, Kuwait, Lebanon, Lesotho, Liberia, Libya, Madagascar, Malawi, Mali, Marshall Islands, United Arab Emirates. 

The prices appearing on the website are indicated in euros (all taxes included), excluding delivery charges. The prices appearing on your order after its validation and its recording are firm and definitive: if the prices fall a few days after the order, we will not be able to compensate you for the difference; if the prices increase, we are committed to deliver you at the price fixed the day of the order. The prices invoiced at the time of the order are those in force in the current catalog. 

1. The return can only concern products that have not been altered in any way and that arrive in their original packaging. Software, audio or video recordings, newspapers, products concerned by hygiene or health protection constraints and consumables can only be returned if they are still in their original intact envelope, sealed and not having been activated. Article L221-28 of the Consumer Code states the contracts for which the right of withdrawal cannot be exercised. The expenses and risks of transport are for the professionals with the load of the customer. The only transport costs borne by Innovations On Line Products are the costs of reshipping returned products at the customer's expense for exchange following a real operating defect; provided that the customer is in metropolitan France. No material can be exchanged before its return to the premises of Innovations On Line Products. Before any return of a backup unit for an intervention by our services, the customer will have to take care to carry out himself a backup of his data. 
2.  Any complaint, on the apparent defects or on the nonconformity of the delivered product, in connection with the ordered material, will have to be notified in writing either by registered letter with acknowledgement of receipt or by e-mail to the address: contact@chicled.fr material could not be taken back or exchanged without the express agreement of the company Innovations On Line Products. 

The payment is cash with the order, net and without discount. In the absence of payment, the company Innovations On Line Products will not take into account the order. Any delay or failure to pay will result in late payment interest equal to three times the legal interest rate. All the expenses that Innovations On Line Products will judge useful to engage to recover the payment is the responsibility of the customer. In application of article L.441-6 of the Commercial Code, an indemnity of 40€ is automatically due, by all professionals, for each invoice paid late and this from the 1st day of late payment whatever the deadline applicable to the transaction. This indemnity is due in addition to the late payment penalties and does not exclude the possibility of requesting additional compensation. 

The customer has a period of 15 days upon receipt of his order to exercise his right of withdrawal. He/she must inform Innovations On Line Products of his/her wish to withdraw using the form available on the Innovations On Line Products website or by any other clear means. The customer then has a maximum of 15 days to return the order at his own expense and request a refund. 

The delivered equipment has an exclusive commercial warranty of 36 months for the equipment, 60 months for the batteries (except for the 36-month solar ramps) and 25 years for the solar panels. 

This exclusive warranty is acquired on products purchased only from the websites of Innovations On Line Products and its distributor partners. 

Innovations On Line Products shall in no case be held responsible for unforeseeable, indirect or immaterial damages, linked to a non-conforming use of the product sold by Innovations On Line Products. 

The photos are not contractual. You have the right to access, modify, rectify and delete data concerning you (article 34 of the law "Informatique et Libertés" of January 6, 1978). 

The spare parts referenced on our commercial supports will be available for 3 years from the date of purchase of the main product. It is reminded that the benefit of the commercial guarantee does not prevent the application of the legal provisions relating to the legal guarantee of conformity and the guarantee of hidden defects (legal guarantees) reproduced below. 

Article L217-4 of the French Consumer Code: The seller delivers goods in conformity with the contract and is responsible for any defects in conformity existing at the time of delivery. He is also responsible for defects in conformity resulting from the packaging, the assembly instructions or the installation when the latter has been put at his charge by the contract or has been carried out under his responsibility. 

Article L217-5 Code de la consommation : The good is in conformity with the contract: 

If it is suitable for the use usually expected of a similar good and, if necessary : - if it corresponds to the description given by the seller and has the qualities that the latter has presented to the buyer in the form of a sample or model - if it has the qualities that a buyer can legitimately expect in view of the public statements made by the seller, by the producer or by his representative, particularly in advertising or labeling; 

Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and accepted by the latter. 

Article L217-12 Code de la consommation : The action resulting from the defect of conformity is prescribed by two years as from the delivery of the good. 

Article L217-16 Code de la consommation : When the buyer asks the seller, during the course of the commercial guarantee which was granted to him at the time of the acquisition or the repair of a movable good, a repair covered by the guarantee, any period of immobilization of at least seven days are added to the duration of the guarantee which remained to run. This period runs from the date of the buyer's request for intervention or from the time the item in question is made available for repair, if this availability is subsequent to the request for intervention. 

Article 1641 Civil Code: The seller is bound by the warranty for hidden defects of the thing sold which make it unfit for the purpose for which it was intended, or which so diminish this use that the buyer would not have acquired it, or would have given only a lower price, if he had known about them. 

Article 1648 paragraph 1 of the Civil Code: The action resulting from redhibitory defects must be brought by the buyer within two years from the discovery of the defect. 

It is recalled that under the legal guarantee of conformity, the consumer : Has a period of two years from the date of delivery of the goods to act against the seller; Can choose between repair or replacement of the good, subject to the conditions of cost provided for by Article L. 217-9 of the Consumer Code; Is exempted from proving the existence of the lack of conformity of the good during the six months following the delivery of the good. This period is increased to 24 months from March 18, 2016, except for second-hand goods. 

The legal guarantee of conformity applies independently of the commercial guarantee that may eventually cover your good. It is recalled that the consumer may decide to implement the warranty against hidden defects of the thing sold within the meaning of Article 1641 of the Civil Code and that in this case, he can choose between the resolution of the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code.

Innovations On Line Products expressly reserves ownership of the goods delivered until full payment of their price in principal and interest. The simple handing over of a title of payment does not constitute a payment. The above provisions do not prevent the transfer to the buyer of the risks of loss or deterioration. In the absence of full payment, Innovations On Line Products shall have the right to demand the immediate return of the delivered equipment. The expenses which could be engaged for this restitution will be the responsibility of the customer. 

The company Innovations On Line Products could not be held for person in charge of the non-fulfilment of the concluded contract, due to the occurrence of an event of absolute necessity. 

With regard to products purchased to satisfy professional needs, Innovations On Line Products shall not be held liable for any indirect damages, operating losses, loss of profit, damages or expenses that may arise. 

Innovations On Line Products, like any distributor, collects from its customers an ecoparticipation, included in the selling price, in order to finance the collection and recycling of Waste Electrical and Electronic Equipment (WEEE). 

For all electrical and electronic equipment products, in accordance with article R.543-180 of the Environment Code, any customer can benefit from a right to free return of their WEEE. The request for return of the product must respect the principle of ' 1 for 1 ': Innovations On Line Products takes back your old product for any product of the same type bought within the framework of the remote sale. 

A disposal channel for electrical and electronic household appliances at the end of their life has been created in France, in order to ensure an environmentally friendly treatment. 

Thus, dear consumers and customers, you should no longer throw away end-of-life equipment with other household waste. They contain substances and components that are dangerous for the environment and the health of us all. 

You must deposit them in a collection point provided for this purpose: By going to the waste disposal center of your town or city. 

The Environment Code indicates that in case of sale of an electrical or electronic household equipment, the distributor, including in case of remote sale, takes back free of charge or makes take back free of charge for its account, the used electrical and electronic equipment which the consumer gets rid of, within the limit of the quantity and the type of equipment sold. 

As a reminder, the request to take back the product must respect the "1 for 1" principle. For this reason, Innovations On Line Products will take back your old product free of charge for any new product of the same type purchased on the site. If the product requires the intervention of a carrier, the return will be done by the carrier who came to deliver you. 

In accordance with the law n° 2004-575 of June 21, 2004 concerning the confidence in the digital economy, it is specified that :
